General terms and conditions

Article 1 | Definitions
 

• The following definitions apply in these general terms and conditions:
• Lessor: Casa Momo, located at Gonnetstraat 24, 2011 KA Haarlem, registered with the Chamber of Commerce under number 93100094.
• Lessee: the party with whom the lessor enters into an agreement for the use of the studio.
• Agreement: the arrangements between the lessor and the lessee regarding the use of the studio to which these general terms and conditions apply.
• The Leased Premises / The Studio: the space located at Gonnetstraat 24, Haarlem, rented out by the lessor. The space is on the ground and first floors. There is no elevator, nor is photographic equipment provided (the lessee must arrange this if needed).

Article 2 | Applicability

​

• These general terms and conditions apply to all offers, quotations, agreements, and other services provided by the lessor unless otherwise agreed in writing.
• The general terms and conditions of the lessee do not apply and are rejected by the lessor.
• Deviations from these terms and conditions are only valid if agreed upon in writing.
• The most recent version of these terms and conditions applies.
• If one or more provisions of these terms are found to be wholly or partially void or voidable, the remaining provisions shall remain in full force.

Article 3 | Offers and Quotations

​

• All offers and quotations by the lessor are non-binding unless explicitly stated otherwise.
• Without a written acceptance period, an offer/quotation expires after 14 calendar days.
• The lessor is not bound by an offer if the lessee can reasonably understand that it contains a manifest error or typo.
• A booking is only final when it has been confirmed in writing or electronically by the lessor.
• The location depiction is indicative and may differ at the time of use, which the lessee accepts.
• The lessor reserves the right to refuse a booking without providing further justification.

Article 4 | Rental Period, Rates, and Payments

​

• The rental period is specified in the agreement.
• Payment must be made according to the terms outlined in the agreement. A reservation is only final after full payment.
• If the lessee wishes to extend the booking duration, they must submit a request. The lessor will assess whether an extension is possible.
• Any additional time used during an extension will be billed to the lessee at the agreed-upon rate.
• The lessor reserves the right to adjust rates. Adjusted rates will be communicated as soon as possible. If rates change after an agreement is established, the lessee may terminate the agreement without incurring liability.
• If the lessee fails to make payment, they are required to cover reasonable out-of-court collection costs.
• The lessor reserves the right to deny access to the premises to lessees or guests who violate these terms and/or house rules.

Article 5 | Obligations of the Lessee

​

• The lessee must use the leased premises with care and in accordance with the house rules.
• The lessee must compensate the lessor for any damage to the leased premises unless caused by normal wear and tear.
• The lessee is responsible for the conduct and actions of their guests.
• It is prohibited to use the premises for pornographic purposes or activities that may cause harm or are contrary to public order or morals.
• The lessee must ensure that their guests are never left alone in the premises and must lock the premises when leaving.
• The lessee must leave the premises clean and switch off the lights. If not, the lessor may charge €80 excl. VAT for cleaning costs.
• The lessee must ensure that neighbors are not disturbed by noise or other nuisances caused by the use of the premises.

Article 6 | Execution of the Agreement

​

• The lessor will execute the agreement to the best of their knowledge and ability.
• The lessee is responsible for receiving their guests and managing the use of the studio during the booked time slot.
• A door access code will be provided to the lessee for the studio. This code may only be used during the rental period and must not be shared with third parties.
• It is prohibited to bring flammable or dangerous objects into the studio.
• Coffee and tea are provided free of charge. If the lessee brings their own food or drinks, they may only be consumed at the dining table. Catering is available upon request.
• Pets are not allowed in the premises unless prior written consent is given by the lessor.

Article 7 | Penalty Clause

​

• If the lessee violates any provision of Articles 5 or 6, they shall, without requiring further notice, owe the lessor an immediately payable penalty equal to the rental fee per violation. Additionally, the lessor reserves the right to claim full compensation if actual damages exceed the penalty amount.

Article 8 | Booking, Cancellation, Changes, and Force Majeure

​

• Available time slots are 1, 2, 4, 8, or 12 hours, which may be deviated from in writing upon agreement.
• Cancellation must be made in writing. Cancellations made up to 72 hours before the rental period may be rescheduled or transferred free of charge, subject to the lessor's discretion. Rescheduling or transferring is allowed once; a second request incurs a €50 fee.
• Cancellations within 72 hours of the rental period are subject to a 50% charge of the rental fee.
• In cases of force majeure (e.g., pandemics), the lessor may suspend, reschedule, or cancel the agreement without owing compensation.

Article 9 | Liability

​

• The lessor is not liable for damages to the lessee or associated parties unless caused by the lessor’s intent or gross negligence.
• The lessee indemnifies the lessor against third-party claims related to the rental period.
• The lessee is liable for damages caused by themselves or their guests.
• The lessee must maintain adequate liability insurance.
• Use of the studio is at the sole risk of the lessee and their guests.
• The lessor is not responsible for losses, theft, or damage to personal belongings.
• The lessor’s liability is limited to the amount covered by liability insurance or, if no payout occurs, the rental fee charged for the period.

Article 10 | Intellectual Property

​

• All intellectual property rights to materials and information provided by the lessor remain with the lessor.
• By entering into the agreement, the lessee grants permission for the use of images for promotional purposes unless explicitly objected to in advance.

Article 11 | Privacy

​

• If personal data is processed, this will be done in accordance with the lessor's privacy policy, which is available online.

​

Article 12 | Complaints and Disputes

​

• Complaints must be submitted in writing within 7 calendar days.
• Disputes will be submitted to the competent court in the district of North Holland, location Haarlem, but both parties will first strive to resolve the issue amicably.
• Dutch law applies in all cases.
